When Is A Family Report Ordered?
A Family Report is generally ordered when an individual case is heading toward final hearing.
What Happens In A Family Report?
The process of a Family Report involves:
- A risk assessment of child abuse, family violence, mental health as well as drug and alcohol abuse.
- The parties will each be interviewed separately, as well as any significant others who are involved in the lives of the children - for example a new partner or a grandparent who may provide regular care, or anyone else residing in the home.
- Evaluating the relationship, as well as the communication between the parties.
- Child developmental needs.
- Child views in relation to family dynamics and circumstances.
- Family dynamics - current and historically.
Will My Child/ren Have To Be Interviewed?
Each child is given the opportunity to have their wishes heard, but no child is made to do so.
Is Information I Provide During Any Interview Confidential?
All information provided is admissible in Court, and therefore NOT confidential.
Do I Receive A Copy Of The Family Report?
Yes. A copy of the Family Report will be provided to your lawyer.
If you do not have a lawyer you will be provided a copy directly.
Can I Share The Family Report?
Not without permission from the Court.
It is an offence to do so.
The Report will cover the arrangements for the care of the children and the children’s needs.
It will also contain an assessment of the relationship between you and the children, the children’s needs, attachment and views.
Fee:
$10,000 (+GST) for a standard report of two parties and two children.
There is an additional fee of $550 (+GST) for any additional persons to be interviewed.
$200/hr (+GST) after four hours of subpoena reading (maximum of eight hours)
